At SAFE Family Courts Scotland, we are building a blueprint for change, dismantling the systemic failures that currently plague Scotland’s family justice systems.
The Family Court System is Failing Children
The Family Court and Child Maintenance systems should be a shield for children. Today, they are too often used as a weapon.
We are SAFE Family Courts Scotland. We are a movement dedicated to exposing and eradicating the systemic failures that allow post-separation abuse to flourish within our legal and financial systems.
For too many families in Scotland, the end of a relationship is not the end of the conflict—it is the beginning of a cycle of litigation, financial exhaustion, and trauma. We see a recurring ‘pincer movement’ - the weaponisation of false allegations and pseudoscientific narratives in court, combined with the manipulation of the Child Maintenance Service to perpetuate poverty and control.
This system is being exploited for profit, with families forced to fund high-cost, private psychological interventions that often serve to prolong conflict rather than resolve it. This is not justice; it is systemic failure.
We Stand For:
S — Systemic Accountability: We demand total transparency in court proceedings. Sheriffs must provide clear, written justifications for their decisions, grounded in fact and rights, not opinion.
A — Advocacy for Children: Children are not assets. Their voice and lived experience must be the primary, consistent, and independent focus of any legal process, from start to finish.
F — Fairness in Evidence: We demand an end to the reliance on discredited psychological theories and untested "expert" opinions. Justice must be based on objective, trauma-informed, and peer-reviewed reality.
E — Eradicating Abuse: We are committed to stopping the use of the Family Courts and the Child Maintenance Service as tools for post-separation coercive control.
Our Core Beliefs
Children are not assets: The child’s well-being is not a prize to be won in a court battle; it is the fundamental priority that should guide every decision. The child’s voice and their lived experiences must form a foundational basis for any orders that are made which affect them, and this must be the case from the outset of any legal proceedings.
The system is not neutral: A system that claims to be neutral but allows and enables the continued abuse of vulnerable parents and children is, in practice, complicit in that abuse.
Evidence must prevail over opinion: Decisions regarding a child's future must be based on proven, trauma-informed, and peer-reviewed reality—not on the weaponised rhetoric of ‘parental alienation’. The untested opinion of individual ‘experts’ must never be used to justify child removal from loving and supportive homes.
Justice should not be a commodity: We believe no parent should be forced to choose between poverty and their child’s safety, yet our current systems (Family Court and CMS) often force exactly that choice. The current reliance on private, high-cost psychological interventions creates a tiered system of justice. We reject a model where a family’s outcome is determined by their ability to pay for expert testimony or the therapeutic services recommended by those same experts. The court must be an arbiter of truth, not a facilitator for private profit-driven litigation.
Our Pledge
We believe that no parent should be forced to choose between poverty and their child’s safety. We will not be silent until the Scottish family justice system is transformed into an environment which truly protects the vulnerable and prioritises the well-being of the child above all else.
